MYOB Partner Program Terms and Conditions

Terms and conditions for MYOB's Partner Program.

About the MYOB Partner Program

1. The MYOB Partner Program (Program) is a free tier-based loyalty program designed to support and reward accounting and bookkeeping practices in Australia and New Zealand.

2. Key purposes of the Program include:

  • Referral and Retention: Encouraging practices to refer MYOB software to their SME clients and retain those clients by rewarding them with points and benefits.

  • Professional and Business Development: Providing opportunities for practices to complete certifications through the MYOB Academy, attend MYOB events, and participate in promotions, which in turn earn them points and status credits.

  • Tier-Based Rewards: Offering a structured system where practices can achieve different tiers (Purple, Silver, Gold, Diamond) based on the points they accumulate. Higher tiers provide greater rewards and benefits.

  • Engagement and Education: Incentivising practices to stay updated with MYOB’s products and services through continuous learning and engagement, which is crucial for maintaining their tier status and unlocking further benefits.

About these terms

3. These terms and conditions (Terms) govern your participation in the Program. By applying to join the Program, you agree to be bound by these Terms and any other policies or guidelines that we may issue from time to time.

4. These Terms operate in addition to your Sales and Services Agreement and the MYOB Practice Terms of Use. Unless otherwise defined in these Terms, any capitalised terms have the meaning given to them in the Sales and Services Agreement.

Eligibility and application

5. To be eligible to join the Program, you must:

  • agree to these Terms;

  • complete and submit the online application form;

  • be a registered business in Australia or New Zealand;

  • have a valid ABN or NZBN;

  • not be a member or participant of another similar MYOB program (such as the MYOB Enterprise Business Partner Program);

  • provide or imminently intend to provide professional services to clients using MYOB products, such as accounting and bookkeeping; and

  • you have at least one client, or imminently intend to have at least one client who uses at least one MYOB product, such as MYOB Business.

6. We may accept or reject your application at our sole discretion. If we accept it, we will email you and put you in a tier based on your performance and compliance with the Program requirements. We will also give you access to the partner hub where you can see your benefits and points progress.

7. MYOB may terminate your membership if, within three months of joining the Program with the intention to use MYOB products professionally or to serve clients who use MYOB products, you fail to meet these criteria.

8. If any of the information that you gave us when you joined the Program changes, you need to let us know in writing as soon as possible.

Partner Conduct Requirements

9. You must:

  • provide MYOB customers professional and high-quality services;

  • meet all reasonable customer expectations;

  • take reasonable steps to promote and enhance MYOB’s reputation;

  • behave in a way that does not harm or tarnish the reputation of MYOB, its products or services;

  • join in MYOB sponsored activities (if applicable);

  • follow all relevant laws and regulations, including privacy, consumer and spam laws, when you run your business and carry out your duties under these Terms; and

  • respond within 14 days to any complaints that MYOB receives about your services.

Program Benefits

10. As a partner, you are entitled to receive the benefits for your tier, as set out in the Program Website. These may include:

  • the choice between receiving a discount on the wholesale price of select MYOB products and services for yourself and your clients (Discount) or a commission for successfully selling or referring select MYOB products (Commission);

  • access to training, certification and accreditation programs;

  • access to marketing support, materials and campaigns;

  • access to technical support, product updates and feedback channels;

  • recognition and promotion on our website and at events (subject to MYOB’s discretion and only with mutual agreement);

  • access to exclusive offers;

  • exclusive events, webinars and networking opportunities; and

  • other MYOB products or services.

11. Where the benefits include MYOB software, that software is solely for your internal business use and must be used in accordance with the product's terms of use. The license granted to use this software is exclusive to you and may not be sublicensed.

Program communications

12. By joining the Program, you consent to receiving marketing communications from us, including promotional offers. Unless you opt out, you agree to us communicating with you via various channels (including by email, SMS and phone).

13. You can opt out by adjusting your communication preferences via the unsubscribe link in certain communications. There are, however, some messages that we must be able to send you as a member of the Program. These include, for example, messages relating to changes to your membership, important information about products or services that you have purchased, updates to terms or changes to the Program. If you do not want to receive these communications, you can cancel your Program membership by logging a support case via your Partner Dashboard requesting cancellation of your membership.

Program Tier requirements

14. To keep your tier status, you must meet the Program requirements listed on the Program Website, this includes earning a specified number of Status Credits. Status Credits are earned through specific actions like completing training or attending MYOB events.

15. Along with earning Status Credits, you need to maintain quality service, follow MYOB branding and conduct guidelines, provide accurate business information, and assist in any Program or product evaluations conducted by us.

How to earn Status Credits

17. Status Credits earned by a Program member will be accredited to the associated membership profile (whether individual, accounting, bookkeeping or professional services firm).

18. Status Credits for eligible activities completed by you or authorized users will be added to your account and tallied with your total. If an authorized user exits your business, their Status Credits will no longer count towards your total.

19. We may correct any inaccuracies in Status Credit allocation by adding or deducting them as necessary, particularly if you cancel an activity or violate Terms. Regularly review your account for discrepancies and report them within 30 days.

20. Status Credits can't be traded for cash or transferred. They are solely for Program members and for defined activities and might expire based on your membership level; expiry details are on the Program Website.

Tier assessment and reassignment

21. We periodically review your performance and adherence to Program rules. The assessment results and any tier changes will be emailed to you and updated in Partner Hub.

22. If you qualify for a higher tier, we might promote you and award the respective benefits within five business days after you've earned the necessary Status Credits.

23. If you don't maintain the standards of your current tier, we might demote you to a lower tier.

24. We reserve the right to change your tier immediately if we find that:

  • you violated these Terms;

  • you've engaged in fraudulent, unethical or illegal activities concerning the Program or MYOB products;

  • you've misrepresented yourself, your work, or clients to us or publicly;

  • you've supplied us with inaccurate, incomplete, or outdated data;

  • you haven't cooperated during our audits or reviews;

  • you've harmed MYOB's reputation or brand; or

  • you've stopped servicing clients using MYOB products.

25. If you're reassigned, we'll inform you via email. You can contest this by submitting written evidence or arguments within 14 days of the notice. We'll consider your appeal and get back to you with our final decision within another 14 days. Our decision will be final and binding.

How to set up and receive either a Commission or a Discount

26. There are two types of rewards members who successfully refer eligible subscriptions to their clients through the Partner Dashboard or via their MYOB Partner Manager: Discount or Commission. You can only get one type of reward per transaction, in addition to applicable Status Credits.

27. All new members will have their reward preference automatically set to Discount.

28. You can switch your reward preference to Commission any time within your Partner Hub. For more information on how to switch your reward preference, see here. The switch will only affect future transactions.

29. Commissions will only be paid to program members who have entered their bank details in their Partner Hub. It is up to you to make sure that the right bank account details are in your Partner Hub to receive the Commission. If you don't enter your correct bank account details, you will lose any Commission that you could have otherwise may been entitled to.

30. Which products and services attract Commission or Discount? Contact your MYOB Partner Manager to see a list of eligible products that attract Commission or Discount.

31. How do I make a referral? Use the Partner Dashboard to refer online. If you can't do it online, contact your MYOB Partner Manager to refer and buy.

32. What Discount can I receive? The Program Website shows the percentage discount you can get for each Program tier. Discounts are a percentage off the normal price of the MYOB product or service (excluding GST). Unless we say otherwise, the Discount depends on your Program tier at the time of purchase. That Discount applies for the life of that subscription, even if your Program tier changes after the time of purchase. MYOB may offer you discounts that are higher than the ones for your Program tier. When these offers end, unless we tell you otherwise, the price will go back to the Discount you usually get for your current Program tier.

33. How can I earn a Commission? To get a Commission, you need to refer a client who pays for a qualifying MYOB product or service with your quote (Client Pays). This may also give you Status Credits. You can only get Commission for the first 5 years of the subscription. There is no Commission if you purchase the subscription yourself (Partner Pays).

34. What types of Commission are available?

  • You get an ongoing Commission from MYOB. This is a percentage of each payment (excluding GST) that the client you referred makes to MYOB for a product or service.

  • Commission is calculated and paid monthly or yearly (as advised by MYOB), within 30 days after the period. You don't Commission it if the client's subscription is in arrears for the period.

  • Commission lasts for five years from when MYOB gets the first payment from the client t.

  • The percentage of Commission depends on your Program tier, unless otherwise stated. Please see the relevant Program Website. The amount of Commission you receive is based on your Program tier at the time you make a qualifying sale. This Commission rate will not change for that sale, even if your Program tier changes later.

35. How can I receive my Commission? Commission will be paid to the bank account listed in your my.myob account.

36. If you receive a Commission or Discount that you are not eligible for, we can either: deduct that reward from any future rewards that you are entitled to; or ask you to return that reward to MYOB.

37. What happens to the Discount or Commission if you transfer a subscription from Partner Pays to Client Pays?

38. If Discount was your reward preference when you purchased the Partner Pays subscription, this Discount will remain applicable even after the file is transferred from Partner Pays to Client Pays. However, if you selected Commission as your reward preference with the Partner Pays subscription, the Commission will be replaced with a Discount equivalent to your Program tier at the time of transfer when switching to Client Pays. The Discount will remain valid as long as the client remains connected with your practice, for example, if you continue to be an authorised user on the client file.

Program Tier Logos

39. MYOB will provide Program members with access to a selection of MYOB logos for them to indicate their Program tier. MYOB grants you non-exclusive, royalty free, personal, non-transferable and revocable licence to use the Program tier logo that matches your level for the length of your Program membership solely in Australia and New Zealand.

40. Upon changing your Program tier, you must:

  • stop using the Program tier logo from your former tier and may start using the Program tier logo for your new tier, if available; and

  • make reasonable efforts to switch to the Program tier logo of your new tier.

MYOB will grant you a 3-month period to discontinue using the Program tier logo from your previous tier.

41. You must adhere to all of MYOB's notified requirements regarding the licensed logo usage and must only utilize the licensed logo in ways specified by MYOB.

GST and Rewards

42. All rewards and other benefits that you receive from MYOB are exclusive of any GST, unless we explicitly state otherwise. If GST applies to any reward or benefit, we will add it at the current rate.

Tax invoices for taxable supplies

43. If you are registered for GST and you provide MYOB with a taxable supply, you and MYOB agree to the following terms regarding tax invoices:

  • MYOB can issue tax invoices for these supplies on your behalf.

  • You will not issue tax invoices for these supplies yourself.

  • You confirm that you are registered for GST when you enter into this agreement with MYOB and will inform MYOB if you stop being registered for GST at any point.

  • MYOB confirms that it is registered for GST when it enters into this agreement with you and will inform you if it stops being registered for GST at any point.

  • MYOB will send you the original or a copy of the tax invoice for each taxable supply within 28 days of making or determining the value of the supply.

Termination and suspension of your Program membership

44. You can end your Program membership by providing 10 days' written notice by logging a support case from your Partner Dashboard.

45. We may, where it is in our legitimate interest to do so, terminate your Program membership at any time by giving you written notice if we reasonably determine that you:

  • have breached these Terms, or any other policies or guidelines that we may issue from time to time;

  • apply unreasonable pressure on a client or potential client to complete a purchase, in order for you to secure a benefit;

  • have engaged in any fraudulent, unethical or unlawful conduct in relation to the Program or MYOB products;

  • encourage MYOB clients to cancel and then reapply for a product or service (so called ‘churning’);

  • engage in any other inappropriate method of collecting Status Credits, commissions, discounts or other benefits;

  • have misrepresented yourself, your business or your clients to us or to the public;

  • have provided us with false, incomplete or outdated information;

  • have failed to cooperate with us in any audits that we may conduct;

  • have damaged or tarnished the reputation or goodwill of MYOB or its products; or

  • have ceased to provide services to clients using MYOB products.

46. We may, where it is in our legitimate interest to do so, suspend your Program membership or any of the benefits you receive, at any time, if we need to investigate, verify or resolve any issues or complaints relating to you or your business. Should such a suspension take place, we'll notify you either via email or the Partner Hub. Once our inquiry, verification, or problem-solving process is complete, we will either reinstate, terminate or vary your Program membership. Where our decision may have an adverse impact on you, we will provide reasons. We’ll act reasonably in exercising this right to suspend your membership, including conducting investigations in a timely manner.

47. Upon termination or suspension of your Program membership, you must:

  • stop using and return or destroy any materials, resources or tools that we have provided to you as part of the Program;

  • stop claiming or implying any affiliation or endorsement by MYOB;

  • pay any outstanding fees, charges or debts that you owe to us or our affiliates; and

  • comply with any other directions that we may give you.

48. Termination or suspension of your Program membership will not affect rights or obligations that have accrued before the termination or suspension, or any provisions that are intended to survive the termination or suspension.

Client Information

49. You must comply with all relevant laws and regulations regarding handling personal information. Your obligations include:

  • securing consent from your clients and other individuals when their personal information is shared with or received from us or our affiliates in connection with the Program;

  • clearly communicating to these individuals how their personal information will be used and disclosed, and informing them of their right to access and correct it;

  • ensuring that any personal information shared with or received from us or our affiliates is accurate, complete and current;

  • implementing appropriate measures to safeguard personal information against unauthorized access, use, alteration, or destruction;

  • promptly alerting us of any actual or suspected privacy or security incidents involving such personal information.

50. If you are utilising the “Partner Pays” payment method (for more information on this payment method, refer to the MYOB Practice terms of use), you confirm that you have recorded your clients’ consent to be contacted by MYOB on an ongoing basis (until they opt out) for the purposes of direct marketing by telephone, electronic message (including email) and other means. You must notify us if your customer opts out of marketing.

Intellectual property rights

51. MYOB and its affiliates own all intellectual property rights for the Program, the Program Website, and related materials (ProgramMaterials). You agree to:

  • use the Program Materials only for Program purposes;

  • not alter, reverse engineer, or create derivatives of the Program Materials;

  • not copy or distribute the Program Materials without written consent; and

  • not remove or modify any copyright, trademark, or proprietary notices on the Program Materials.

52. We grant you a non-exclusive, non-transferable, revocable, and limited license to use the MYOB name, logo, and trademarks (MYOBMarks) provided by us or our affiliates as part of the Program, subject to these Terms. You agree to:

  • use the MYOB Marks solely for Program purposes;

  • follow MYOB brand guidelines and instructions;

  • use your Partner tier status badge from the Partner Hub to promote your relationship with MYOB;

  • avoid implying representation of or authority to bind MYOB or its affiliates;

  • not use the MYOB Marks misleadingly, deceptively,

  • not use the MYOB Marks in a way that that is harmful to MYOB;

  • not use the MYOB Marks in ways that infringe third-party rights or violate laws; and

  • not attempt to register or claim ownership of MYOB Marks or similar marks.

53. We may revoke or change your license to use the MYOB Marks at any time with written notice, and you must promptly comply.

1. We may, where it is in our legitimate interest to do so, change these Terms or elements of the Program (such as eligible activities and rewards) from time to time. This could include terminating the Program. We will provide reasonable notice in respect of any material changes. We will provide you with notice by email or notification in the Partner Hub. If you do not wish to be bound by the changes, you can cancel your Program membership by logging a support case via your Partner Dashboard requesting cancellation of your membership. If you do not cancel your Program membership before the changes take effect, you will be deemed to have accepted the changes.

2. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect, unless to do so would alter the basic agreement between you and MYOB, in which case either party can terminate your Program membership at its election.

3. No waiver of any provision of these Terms, or any breach of these Terms, will be effective unless it is in writing and signed by us. No waiver of any provision or breach will be deemed to be a waiver of any other provision or breach, or a continuing waiver of the same or any other provision or breach.

4. Nothing in these Terms creates or implies any partnership, joint venture, agency, fiduciary, or employment relationship between you and us. You and we are independent contractors and neither of us has any authority to bind or commit the other in any way.
